"Ticket Oosumo English" Service Use Agreement

"Ticket Oosumo English" (the "Service") is a service operated by the Nihon Sumo Kyokai ("Nihon Sumo Kyokai") and PIA Corporation ("PIA") pertaining to the sale of entertainment event tickets by Internet website. It is hereby requested that all use of the Service be based on acceptance of the following "Service Use Agreement" (the "Agreement") determined by the Nihon Sumo Kyokai and PIA (hereinafter collectively referred to as the "Ticket Oosumo Ticket Center").

* Article 1 (Use of the Service)

Upon use of the Service, customers shall observe the general manners, morals and technical rules pertaining to use of the Internet.

* Article 2 (Preparation of Use Environment)

The Service targets persons that have properly readied language, characters, electronic mail and other settings in conformity with the Service. Ticket Oosumo Ticket Center shall assume no responsibility whatsoever for the operation results, or any impact or damages caused by those results, on the part of persons that fail to conform to these conditions. Moreover, even if the aforementioned conditions are satisfied, Ticket Oosumo Ticket Center shall likewise assume no responsibility whatsoever for any impact or damages resulting from cases in which the Service fails to operate properly due to circumstances on the part of customers (operating system, software, LAN environment, etc.).

* Article 3 (Application and Changes in the Agreement)

Customers using the Service shall be considered to have consented to the Agreement. Ticket Oosumo Ticket Center reserves the right to make changes in the Agreement without prior notice, while customers agree to the terms of the Agreement based on confirmation of its terms upon each use. Following changes in the contents, only the contents subsequent to the said changes shall be in force. In addition to the Agreement, customers shall also act in accordance with any other clauses, stipulations or other conditions determined by Ticket Oosumo Ticket Center.

* Article 4 (Sales Targets)

The Service shall target persons residing outside of the nation of Japan who are able to comprehend the English language, as well as persons residing within Japan who are unable to comprehend the Japanese language but capable of comprehending English. If Ticket Oosumo Ticket Center cannot confirm that a customer satisfies the aforementioned conditions, or upon confirmation that a customer has used the Service for commercial purposes, Ticket Oosumo Ticket Center and other sponsors (including operating companies, the same applies hereafter) may invalidate tickets already sold, refuse to recognize refunds of ticket fees and prohibit admission.

* Article 5 (Sales Contents)

  • PIA shall accept consignment of ticket sales operations from the Nihon Sumo Kyokai and other sponsors, and supply the Service in accordance with the Agreement and instructions pertaining to sales methods from the sponsors. In doing so, there may be cases when circumstances dictate the need to establish limits on the numbers of tickets sold, sales methods adopted and other details. In addition, a single booking request may not be used to request tickets for multiple dates or for more than one category of seating.
  • Booking requests shall be accepted on a first-come-first-served basis. Notifications of booking results shall be made by e-mail within a period of 96 hours. Because simply requesting tickets is no guarantee of the ability to purchase tickets, there may be cases when it proves impossible to secure tickets even when a request is received.
  • Seating locations shall be determined by lottery. Notification of ticket numbers shall be made upon issue of the tickets in question. When requesting multiple numbers of tickets, there may be cases when it proves impossible to furnish consecutive seats in a single row.
  • All seats are on a reserved basis. Although no admission is required of children under the age of four (4) years, tickets shall be required in cases when a seat is required for such children.

* Article 6 (Payment of Fees)

  • The only payment method available pertaining to the Service shall be settlement by credit card.
  • When purchasing tickets, in addition to the ticket fee, customers shall also pay a special sales use fee, a system use fee, a commission fee pertaining to payment, a use fee pertaining to delivery of the tickets and other charges assessed as service use fees determined by Ticket Oosumo Ticket Center (hereinafter collectively referred to as "Use Fees") at the time the purchase is made.
  • The ticket fee and Use Fees shall be charged from the designated credit cards upon confirmation of booking requests. The entire value of those charges shall be assessed in Japanese yen. The amount actually charged in the currency of the region where requests are made shall fluctuate by the exchange rate used by the credit card company in question.
  • Ticket Oosumo Ticket Center reserves the right to add or make changes to the various types of use fees, as well as change the method of payment, by providing advance notice to customers through methods judged appropriate by Ticket Oosumo Ticket Center.

* Article 7 (Issue of Tickets)

Tickets shall be issued at the venue site on the date of the event. Details of the issue location shall be provided separately. When picking up the tickets, there may be cases when requests are made for a copy of the e-mail containing results of the booking request, the number of the credit card used to purchase the tickets, a passport or other documents capable of confirming the address and other details pertaining to the person in question.

* Article 8 (Purposes of Use of Personal Information)

The personal information of customers duly entered and recorded (name, address, telephone number) shall be used for the following purposes.

  • For contacts made by Ticket Oosumo Ticket Center deemed necessary with regard to tickets for which purchase requests are received from customers.
  • For actions by Ticket Oosumo Ticket Center to process the collected statistical information in formats rendering it impossible to identify individual customers, for the purpose of grasping use trends pertaining to the Service.

* Article 9 (Disclosure of Personal Information to Third Parties)

With the exception of cases pertaining to any of the following numbered items, personal information of customers duly entered and recorded (name, address, telephone number) shall not be disclosed to third parties without legitimate reason.

  • Cases when customers consent to disclosure of personal information.
  • Cases of contacts from event sponsors, or parties under consignment from event sponsors, pertaining to changes, cancellation or other details of events for which tickets have been purchased, or refunding operations accompanying such circumstances.
    * Note: This shall not constitute a promise to communicate changes, cancellations or other details extending to all events.
  • Cases when the laws recognize such disclosures.
  • Cases of demands from the police, the courts or other public institutions for the purpose of criminal investigation.
  • Other cases deemed necessary to furnish the Service to customers.

* Article 10 (Refusal to Conduct Sales)

In the following types of circumstances, there may be cases when Ticket Oosumo Ticket Center refuses to sell tickets, or, refuses to recognize refunding of ticket fees and disallows admission based on its invalidation of tickets already purchased.

  • Cases of false statements of matters determined by Ticket Oosumo Ticket Center, or cases when required statements fail to be made.
  • Cases of actions causing trouble to other customers or third parties, or cases of behavior serving to obstruct smooth sales operations by Ticket Oosumo Ticket Center.
  • Cases when prescribed procedures are not completed within the period of time announced by Ticket Oosumo Ticket Center.
  • Cases of noncompliance with methods for purchase stipulated by the sponsors and Ticket Oosumo Ticket Center.

* Article 11 (Ticket Exchanges, Changes, Cooling Off)

Customer requests for exchanges, changes or cancellation of tickets for which purchases have already been determined shall be not accepted, regardless of the reason. No cooling off system is applied to tickets sold through the Service.

* Article 12 (Loss or Theft)

Tickets once issued shall not be reissued, regardless of the circumstances (loss, theft, damage, etc.)

* Article 13 (Ticket Refunds)

The sponsors shall provide notifications to customers accompanying changes in the contents or cancellation of the events in question, with PIA assuming no responsibilities consequent to such changes or cancellations. Notwithstanding, there may be cases when Ticket Oosumo Ticket Center, at the request of the sponsors, acts as a proxy in the refunding operations for tickets due to changes in the contents or cancellation of events or other occasions for which the said tickets have been sold. With regard to refunds, the sponsors shall determine the period within which refunds shall be made, with no payments to be made in cases when the stated refund period is exceeded. In addition, no payments shall be made for costs other than the face value of the tickets in question (including commissions, transportation fees, lodging fees, communications expenses, forwarding fees, etc.).

* Article 14 (Termination of Sales)

Sales shall be terminated at the point in time that the scheduled number of tickets of Ticket Oosumo Ticket Center is reached, even if still within the sales period. Sales may be resumed, however, in cases when the sponsors supply additional seats.

* Article 15 (Prohibited Matters)

The resale of tickets purchased from Ticket Oosumo Ticket Center to third parties for commercial purposes, as well as the supply of such tickets to third parties for the purpose of resale, is prohibited. Likewise prohibited is the resale of such tickets at prices higher than the face value of the tickets or actions amounting to attempts at such resale, while resale through auction or Internet ticket auctions, or actions amounting to attempts at such resale are also prohibited. In cases when any of the aforementioned actions are confirmed to have occurred, the event sponsors reserve the right to act on their own judgment to invalidate tickets already purchased, refuse to recognize refunds of ticket fees and deny admission. In cases when such ticket holders have already gained admission, they may be ordered to leave the said premises. In addition, Ticket Oosumo Ticket Center shall assume no responsibilities whatsoever with regard to troubles pertaining to tickets other than those purchased directly from Ticket Oosumo Ticket Center - namely, tickets purchased from "ticket shops," "purchase proxy services," "scalpers" and other sources.

* Article 16 (Compensation for Mistaken Ticket Issue)

The amount of compensation paid by Ticket Oosumo Ticket Center to customers resulting from mistakes in the issue of tickets shall be limited to the face value of the tickets in question.

* Article 17 (Exemption from Responsibility Pertaining to Tickets)

  • Ticket Oosumo Ticket Center shall assume no sales responsibilities with regard to tickets other than tickets purchased directly from Ticket Oosumo Ticket Center.
  • Ticket Oosumo Ticket Center shall assume no responsibilities whatsoever pertaining to damages suffered by customers or third parties in cases when congested telecommunications lines, unexpected accidents in computer systems or other circumstances result in major delays in or the impossibility of confirming ticket requests or the success or failure in completing purchases.

* Article 18 (Service Cancellation, Interruption, Change, etc.)

  • In cases corresponding to the any of the following numbered items, Ticket Oosumo Ticket Center reserves the rights to cancel, interrupt, change, suspend, discontinue or delay the Service.
    (1) Cases of regular or emergency maintenance of the Service system.
    (2) Cases when wars, disturbances, strife, labor disputes, earthquakes, volcanic eruptions, flooding, tidal waves, fires, power failures or other emergency situations render it impossible to supply the Service in normal fashion.
    (3) Cases of service cancellations, interruptions, changes, etc. by telecommunications carriers.
    (4) Other cases when Ticket Oosumo Ticket Center deems it necessary to temporarily suspend operation of the Service.
  • Ticket Oosumo Ticket Center shall assume no responsibility whatsoever to customers pertaining to the cancellation, interruption, change, suspension, discontinuance or delay of the Service in accordance with the stipulations of the previous clause.

* Article 19 (Applicable Laws)

The applicable laws pertaining to the establishment, fulfillment and interpretation of the Agreement shall be the laws of the nation of Japan.

* Article 20 (Court of Jurisdiction)

  • In cases of the occurrence of disputes between customers and Ticket Oosumo Ticket Center pertaining to the Service, the parties involved shall act in good faith to resolve the matters in question.
  • In case when deliberations fail to resolve such disputes, it is agreed that the Tokyo District Court and the Tokyo Summary Court of the nation of Japan shall be the courts of first instance holding exclusive jurisdiction with regard to the matters in question.

Supplementary Provision: The Agreement shall go into force from December 1, 2009.
